TI In Force — DSHS Total-THC Rules ENJOINED
Travis County 455th District Court granted a Temporary Injunction on 2026-05-01 (Judge Daniella DeSeta Lyttle, bond $8,000, industry-wide scope per Order §F p.17). Texas 15th Court of Appeals reinstated the TI on 2026-05-07 after the State's 2026-05-05 interlocutory appeal triggered a brief auto-stay under Tex. Civ. Prac. & Rem. Code § 51.014(b). TI remains in force through trial on the merits 2026-07-27 unless further court order. Separate Texas Supreme Court deadline 2026-05-28.
All Legal in Texas Under Active TI
THCA hemp flower, smokable hemp, pre-rolls, concentrates, Delta-9 edibles (formulated below 0.3%), tinctures, oils, capsules, topicals, beverages, and CBD products are all currently legal to sell and purchase in Texas under TI protection.

Filed 2026-04-07 by THBC + HIFA + 7 co-plaintiffs. Mark Bordas, David Sergei, and the THBC coalition unified into ONE legal team. THCA hemp flower is currently legal to sell and possess in Texas under active Travis County 455th District TI protection (Judge Lyttle, 2026-05-01; reinstated by Texas 15th COA 2026-05-07). Case D-1-GN-26-002511. Trial 2026-07-27.
Sale and Use Both Legal
Under the active TI (granted 2026-05-01 by Judge Lyttle, reinstated by Texas 15th COA 2026-05-07), DSHS 25 T.A.C. Ch. 300 is enjoined. Retail sale, personal possession, and use of compliant THCA hemp products are all currently legal in Texas.
Federal Protection
2018 Farm Bill protects hemp-derived products under 0.3% Delta-9 THC. This federal definition remains in effect until November 12, 2026.

What the Law Actually Says
Texas Agriculture Code §122.001(1) — HB 1325 (2019)
“Hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds of the plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.
The statute says “delta-9 tetrahydrocannabinol” — not “total THC,” not “potential THC after conversion,” and not any other formulation. DSHS does not have the authority to redefine what the Legislature wrote.
